All of the tracts sold by Outcast Land Inc. are covered by basic property covenants that are designed to keep your property value high, in a way that does not limit your enjoyment of the property. “The Tracts at White River” are covered by the following Property Covenants:
- Hunting, camping and recreation (including fishing in the nearby White River) are all highly encouraged at The Tracts at White River, and as such, a cabin or portable building of any size may be constructed and/or used for hunting/camping/recreational purposes on the property. In order to live on the property or use any portion of the property on a day to day/regular basis or in a residential capacity, the loan to Outcast Land Inc. must be paid in full and a residence must exist on the property that meets the requirements of Item #10 (below).
- Camping on the property is permitted for a total of up to 90 days per 12 month period (up to 30 days per 60 day period), but actual camping shall not be restricted during deer season (rifle season), or spring and fall turkey season, even if that would go beyond the aforementioned periods, assuming the property is being camped upon during those seasons for the purpose of hunting.
- No buildings, storage, parking or placements of any kind (including camping) is permitted within 50 feet of the centerline of any shared roadway (easement road) or public road, or within 30 feet of all other property boundaries. These areas shall serve as future utility easement areas and are also intended to add to the privacy of the area and the properties (privacy buffer). Fences must not encroach upon roadway easements which are defined as the area within 50 feet of any easement road or public road.
- No refuse, debris, unused building materials nor derelict vehicles (non-running, unlicensed or both) including buses and RV’s, nor machinery or equipment in whole or in part shall be stored or allowed to collect on any property unless completely enclosed within a permanent building or garage. All properties and improvements shall be maintained in such a manner that they do not become unsightly, in disrepair, unsanitary or a fire hazard. All wastewater treatment facilities must be constructed in accordance with applicable governmental requirements and to ensure that effluent shall be contained on the original parcel of origin. No structure on any tract shall be used in a residential capacity prior to the construction of an adequate wastewater treatment facility on said tract, which shall serve the structure. No interference with natural or existing drainage shall be permitted.
- Livestock and pets are permitted only for non-commercial purposes and only so long as they are not allowed to create a nuisance to nearby land owners or residents. Kennels greater than 5 dogs and feedlots are not permitted.
- No parcel may be subdivided if any of the parcels created or remaining from the division would be less than 5 acres in size, except that developer or their assigns may subdivide to a size no less than 3 acres in size; any parcel divided, whether by developer or others, and any portion thereof, shall be fully bound by these covenants.
- No single wide mobile homes are allowed on the property. Double-wide mobile homes and modular homes are allowed as long as they are no older than five model years when placed on the property and meet the requirements of Item #10 (below). No camper, RV, bus, portable building, shed or shack of any kind shall be used as a residence. Any items used for camping, including tents, shall be stored out of sight of any shared roadways (easement roads and public roads) when not is use. Camping shall be defined as staying on and/or visiting the property without staying in a residential structure on a full continuous concrete foundation, as defined below. As such, no property may be lived upon until the foundation and exteriors walls/roof have been completed (and the loan to Outcast Land Inc. has been paid in full).
- As it is understood that the property may not be used in a residential capacity until after the loan to OutCast Land Inc. has been paid in full, there shall be no mail service or mailing address established or used at the property until that time.
- If in the course of installing/clearing a driveway or approach into a property it becomes apparent that the change in the area between any shared access road and the property has prompted a change in the drainage pattern of that area, it will be necessary to install, in a professional manner, a properly sized culvert between the shared access road and the property. As of this writing, a 20′ plastic culvert (12 inches in diameter) costs around $250 and you will also probably need a load of rock delivered to cover the culvert, which would likely be from $250-$350 (depending on what type of rock you have delivered). In some instances a culvert can be installed with minimum excavation/digging, and machinery is not required. If machinery is required, there are rental companies at which you can rent a mini-excavator for a day which should make installation a breeze. There are also local companies who can install the culvert for you.
- Any residential structure built on the property or moved onto the property must have at least 600 square feet of enclosed/heated living space on one level. Said structure must be permanently attached to an adequate, continuous, concrete foundation (concrete slab, stem wall/crawl space or full basement) of at least 600 square feet in size. “Continuous concrete” shall be either poured concrete or concrete block that has been fully mortared together. All construction shall be done in a “workmanlike manner”. All properties shall be used for recreational or single-family residential purposes (no commercial activity is permitted). No more than one residence shall be permitted on any tract that is smaller than 10 acres in size, while tracts of 10 acres or more in size are permitted up to two residences. All properties shall be used only for private, single family residential purposes (single family residence shall mean a structure containing one dwelling only and occupied by not more than one family), or recreational purposes (hunting, camping).
- No commercial or business activities are allowed except home businesses run wholly within a residential dwelling on the property and that generate no additional traffic along easement roads or public roads. No commercial manufacturing and no noxious or illegal trade or activity is permitted. Only non-commercial rentals of tracts or structures are permitted, and only in the case of renting an entire structure to a single family unit or person with a rental term of at least 7 consecutive days, or renting an entire tract to a single family or person, with a rental term of at least 7 consecutive days. No camps, outfitters, campgrounds, resorts, retreats or other businesses or organizations of any type or kind are permitted.
Also please note that timber with a stump diameter of greater than 8 inches (when measured at ground level) may not be cut or removed until the property has been paid for in full. Allowances shall not be unreasonably denied for normal on-site construction or clearing/maintaining roads and/or trails, and permission for such clearing must be in writing and will be considered on a case-by-case basis.
The covenants are permanent and do stay with the property, even after it has been paid for in full (except that you can do what you like with the timber once the property has been paid for in full).
Unless otherwise noted, all of the properties sold by Outcast Land Inc. are suitable for hunting, camping, building and recreation (if you have specific questions about a property just ask us). These Outcast Land Property Covenants are generally MUCH LESS restrictive than standard zoning or standard property covenants, and they will be helpful in keeping your property value high by helping to keep the area desirable.
All restrictions and covenants have been designed to be minimally restrictive and to help protect and preserve the value of your property. In general, any property may be subject to county, city, development and/or state/federal covenants and restrictions. If you have a question about any of this just let us know!
As all of the tracts sold by Outcast Land Inc. are outside of any city limits, we are not aware of any special regulations or limitations on hunting on the properties. The State Department of Conservation is always the best source for information related to hunting seasons and fishing information. All Outcast Land tracts are located in areas that we believe represent excellent opportunities for hunting, fishing and recreation. The Tracts at White River are some of the ONLY tracts we have ever had that offer the opportunity to fish for numerous types of fish in one of the most popular rivers in the nation, just seconds from the tracts (AND in a proven hunting area).
